DEFINITIONS

Children. “Children” means the lawful blood descendants in the first degree of the parent designated. A person who has been adopted shall be considered a child of the adopting parent. The term “children” shall also include children born after the execution of this Will.

Per Stirpes. The term “per stirpes” means in equal shares to each member of a specified class with the share of any deceased member being divided proportionately among his or her children. It is used in this Will in the same manner and with the same meaning as that term is used in the Statute of Descent and Distribution, §2105.06 of the Ohio Revised Code.

Tax Terms. As used in this Will, estate tax terminology, including without limitation “annual exclusion,” “exemption equivalent,” “gross estate,” “marital deduction,” “net taxable estate,” “taxable estate,” “unified credit,” and any other word or words which, from their context, refer to the Internal Revenue Code, shall have the same meaning as such words have for the purposes of applying the Internal Revenue Code to my estate. Construction and application of such terms shall be in the sole discretion of my Executor consistent with the conservation of my estate and minimization of estate and/or income taxes.

Revocable Living Trust. The term Revocable Living Trust shall refer to my revocable living trust established by me as Trustor and Trustee, which I executed on _____________________________, and which is more formally known as The _____________________________ REVOCABLE LIVING TRUST dated _____________________________.
